Peak Income Advisors (a service of Alldredge Wealth Strategies, LLC) provides financial advisory and consulting services. These Terms of Service govern your use of our services and communications.

1. Acceptance of Terms

By accessing and using Peak Income Advisors' services, you agree to be bound by these Terms of Service. If you do not agree to any part of these terms, you may not use our services. These terms apply to all users, whether they are prospects, clients, or other parties receiving communications from Peak Income Advisors.

2. Service Description

Peak Income Advisors, owned by Spencer Alldredge, CFP®, provides financial advisory services and specialized consulting on Indexed Universal Life (IUL) strategies. Our services are informational and educational in nature.

3. Intellectual Property Rights

All content, materials, designs, logos, images, text, and other elements on Peak Income Advisors' platforms and communications are the property of Alldredge Wealth Strategies, LLC or are used with permission. You may not reproduce, distribute, or transmit any content without written permission from Peak Income Advisors.

4. SMS Communications and A2P 10DLC Compliance

4.1 Description of SMS Use Cases

Peak Income Advisors may send you Short Message Service (SMS) text messages to your mobile device. We send two types of SMS communications:

Transactional Messages:

Appointment confirmations and reminders
Scheduling updates and changes
Service delivery notifications
Important time-sensitive account updates

Marketing and Promotional Messages:

Information about new services and offerings (only if you have opted in)
Educational content related to financial planning and IUL strategies
Special offers and promotions (only if you have opted in)

4.2 Opt-Out Instructions

If you no longer wish to receive SMS messages from Peak Income Advisors, you have the following options:

Reply STOP: You can reply with the text "STOP" to any message you receive. This will unsubscribe you from all future SMS messages.
Email Request: You can send an email to spencer@peakincomeadvisors.com requesting to be removed from our SMS list.

After you opt out, you will receive a confirmation message. If you reply STOP, you will no longer receive promotional or marketing text messages. However, we may continue to send transactional messages necessary for your appointments and services.

4.4 Message and Data Rate Disclosure

Message and data rates may apply for all SMS communications sent by Peak Income Advisors. Message frequency varies based on your service preferences and appointment schedule. You are responsible for any message and data rates charged by your wireless carrier. Standard data and messaging rates apply. Peak Income Advisors will not be responsible for charges incurred by your carrier.

4.5 Wireless Carrier Liability Disclaimer

CRITICAL CARRIER LIMITATION: Wireless carriers (including but not limited to T-Mobile, AT&T, Verizon, and others) are not liable for delayed or undelivered messages. Peak Income Advisors is not responsible for messages that are not delivered due to carrier network issues, technical failures, or other circumstances beyond our control. Delivery of SMS messages is dependent on your wireless carrier's network infrastructure and is not guaranteed. If you experience issues receiving messages, please contact your wireless carrier first, then reach out to us for assistance.

4.6 Age Restriction

SMS services offered by Peak Income Advisors are intended for users who are 18 years of age or older. By providing your mobile phone number or opting in to receive SMS communications, you represent and warrant that you are at least 18 years old and have the authority to provide your phone number for these communications.

4.7 Privacy and Data Protection

For information on how we collect, use, and protect your personal information—including your phone number and SMS communication preferences—please see our Privacy Policy. Your privacy is important to us, and we are committed to protecting your data in accordance with applicable laws and regulations.

5. Limitation of Liability

To the fullest extent permitted by law, Peak Income Advisors and Alldredge Wealth Strategies, LLC (including Spencer Alldredge and any employees or agents) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, even if we have been advised of the possibility of such damages.

Our total liability, whether in contract, tort, or otherwise, shall not exceed the amount you paid for services in the past 12 months.

6. Indemnification

You agree to indemnify, defend, and hold harmless Peak Income Advisors, Alldredge Wealth Strategies, LLC, Spencer Alldredge, and their respective employees, agents, and successors from any and all claims, damages, losses, costs, or expenses (including reasonable attorney fees) arising out of or related to:

Your use of our services
Any breach of these Terms of Service
Your violation of any applicable law or third-party rights
Any content you provide or actions you take based on our services

7. Modifications to Terms

Peak Income Advisors reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website or by sending notice to you via email or SMS. Your continued use of our services after modifications have been posted constitutes your acceptance of the updated terms. We encourage you to review these terms periodically.

8. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions. Any legal action or proceeding relating to these terms shall be brought exclusively in the state or federal courts located in Missouri.

9. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, or if that is not possible, the provision shall be severed. All other provisions shall remain in full force and effect.

10. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Peak Income Advisors regarding your use of our services and supersede all prior or contemporaneous agreements, understandings, and communications.
